Acceptance of terms

By downloading, installing, or using the Tofula app ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Tofula LLC ("Tofula," "we," "us," or "our"), an Indiana limited liability company. We may update these Terms from time to time and will notify you of material changes at least 30 days in advance.

Description of service

Tofula is a mobile application that helps you identify which credit card in your wallet earns the most rewards at stores near you. The App provides card reward-rate information based on publicly available terms, location-based store detection, push notifications suggesting which card to use, transaction logging and savings estimation, and receipt scanning for automatic transaction logging.

Tofula does NOT provide access to your bank or credit card accounts, actual financial advice, a guarantee of any reward amounts, or credit decisions of any kind.

Eligibility

You must be at least 13 years of age to use Tofula. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms. By using Tofula you represent that all information you provide is accurate and current, and that you'll use the App in compliance with these Terms and applicable law.

Accounts and registration

You must create an account to use most features of Tofula. You are responsible for maintaining the confidentiality of your credentials and all activity under your account, and for notifying us immediately of unauthorized access at support@tofula.app. We reserve the right to terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for 24 consecutive months.

Subscriptions and billing

Tofula's free tier is available at no charge. Any paid tier is billed through the Apple App Store or Google Play Store — we do not have access to your payment card information, and billing disputes are directed to Apple or Google. Subscriptions can be canceled anytime through your device's subscription settings and take effect at the end of the current billing period.

Acceptable use

You agree not to use the App for any illegal purpose, attempt to access another user's account or data, reverse engineer the App, scrape or extract data by automated means, transmit malware, bypass security features, impersonate others, or resell access to the App. Violations may result in immediate account termination and, where appropriate, legal action.

Intellectual property

The App, including its design, code, content, and trademarks, is owned by Tofula LLC and protected by US and international intellectual property law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You retain ownership of the data you provide us. The Tofula name, logo, and mark are trademarks of Tofula LLC.

Disclaimers

The App is provided "as is" and "as available" without warranty of any kind, to the maximum extent permitted by law. Reward rate information is based on publicly available data and may be inaccurate or out of date — always verify with your card issuer. We are not a financial advisor; nothing in the App constitutes financial advice.

Limitation of liability

To the maximum extent permitted by law, Tofula and its officers, directors, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability to you for all claims shall not exceed the greater of the amount you paid to Tofula in the preceding 12 months, or $100 USD. Some jurisdictions do not allow this limitation for certain claims, in which case it may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Tofula LLC and its officers, directors, employees, and agents from claims arising from your use of the App, violation of these Terms, violation of any law or third-party rights, or any data you provide to the App.

Dispute resolution

Before filing a legal claim, you agree to contact us at legal@tofula.app and give us 30 days to resolve the dispute informally. If informal resolution fails, disputes are resolved through binding individual arbitration under AAA Consumer Arbitration Rules, not in court, in Indiana or by video conference. You waive the right to participate in class action lawsuits. These Terms are governed by the laws of the State of Indiana. Any claim must be brought within one year of the event giving rise to it.

Third-party services

The App integrates with third-party services including the Apple App Store, Google Play Store, Firebase, RevenueCat, Sentry, and Anthropic. Your use of these services is subject to their respective terms. We are not responsible for the practices of linked third-party sites, including card issuer websites.

Termination

We may suspend or terminate your account at any time if we believe you have violated these Terms. You may terminate your account anytime via Settings → My Account → Delete account. Sections that by their nature should survive termination — Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution — will survive.

General

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tofula regarding the App. If any provision is found unenforceable, the remaining provisions continue in force. You may not assign your rights under these Terms; we may assign ours to any successor entity.
